How To File A Motion To Relocate My Child Out Of State Without Hiring An Attorney

Card image cap

For context, when I filed for custody of my daughter I couldn’t afford a lawyer at the time. I went in blind and had to spend all day in the courthouse working on filing for custody. Eventually before the courthouse closed I got it all done by myself with encouragement from my sister on the phone. I ended up winning the case. My daughter’s father, made a fool of himself in front of the judge. Complaining under his breath as he walked up to the stand to testify, interrupting me when I was telling my side to the judge.

2 years later, he stopped obeying the custody order. Stopped paying child support and most importantly Stopped communicating with his daughter. I never know what his current phone number is until he randomly texts with a new number, or if he is at his previous address I have.

My fiancé got an amazing job opportunity in Florida. Currently in NC, with his income from his current job we are struggling. We have a new baby in the family and I stay home to care for both kids while he works. This relocation will be life changing for all of us.

In order to pursue this dream career of his, we have to take this matter to the court and ask permission to relocate my daughter with us to Florida. With our financial situation we can’t afford an attorney.

Any advice on how I would need to file this motion on my own? There is nothing stating out of state moving in our current custody agreement. It just states the Judge who made the order has authority over future actions in our care through the courts.
