Hoa Broke Into Condo That We Are Selling.

This week, the HOA which I am trying to get away from (hence the selling of the condo) trespassed on the property. One of them used their status as a real estate agent to find the code on the lockbox for the keys and get in. I would like to note that the real estate agent who broke in is NOT the real estate agent who we listed the property under. The two HOA members, had a workman with them who also trespassed on the property as well.

They asked the workman to find flaws in the property which they can use to put a lien on the property and prevent it from selling. We believe that the motivation behind the trespassing is because the real estate agent who broke in is mad that we didn’t list the property under her name.

The neighbors who were home at the time confronted them breaking in and they told her that what was going on was “none of her business” and it was official “HOA” business. The only reason I know they were in the property is because the neighbor texted me right after to let me know they were trespassing.

As a real estate broker, I already know that this real estate agent can lose their license since you are not allowed to use lockbox codes to enter homes for non-real estate purposes. I already reported her real estate license. I want to know what I can legally do against these two individuals and the HOA. I’m going to the sheriff tomorrow to file a report for their trespassing, but would like to know what legal standing I have.

This is all in California btw.
