Gas Pumped Off My Card Without My Permission

Location: washington state

This happened on May 1st. I was trying to get gas at Circle K and the pump wasn't working so I moved to the next pump. While I was getting gas a car pulled up to the pump that didn't work and started getting gas, I thought it was odd. Turns out my transaction never canceled, I thought it had since the pump didn't work.

Since I used my easy pay card, a few hours later I received two emails from easy pay charging me for two transactions. I called circle K and told them what happened, they opened a ticket for me. Every time I called asking for an update I just got the same answer: "it will be resolved soon."

Last Tuesday I called my bank and opened a ticket through them letting them know what happened since I started to get sick of getting the runaround. The next day they gave me a refund for the fraudulent transaction. The day after that I received an email from circle K saying this:

"Your transaction using Easy Pay, account (*) that occurred at Circle K - **** was returned unpaid by your bank. As a result, your Easy Pay payment account has been placed on hold.

If this transaction was returned due to non-sufficient funds or any other reason, our collection agent CHECKredi will electronically debit your account for the original transaction amount. Your account will also be debited $40.00, the return check fee“

I never even asked my bank for a refund, although I obviously wanted one. I assumed they figured it out and refunded me therefore everything was OK. Now I have gone from annoyed to pissed off. Does anyone have any advice or experience with anything like this?

My next step is to call my bank and let them know what happened, then call circle k again. I appreciate any input. I also have their license plate and make and model of their car, which I gave to circle k. TIA

Edit: filed a police report, basically they won't be doing anything about it.
