Father Passed Away, No Will, Surviving Spouse Not On Deed Or Mortgage

Card image cap

Location: Delaware

Father passed away 19 years ago, he had no will. He was married for 1 year, she was never added to the deed or mortgage. For 14 years after his death she lived there and paid the mortgage. 5 years ago she bought another house and let her son live in my fathers house. I always thought the house just went to her because they were married. Well, today she called because she wants to now transfer the house to her name and she informed me that I need to be involved because the property is intestate. From what I can see online in Delaware she would be entitled to 50% of the estate and I would get the other 50%. Although I'm not sure of this. It also says she gets lifetime rights.

So now that I know I might have some rights to this house, I am very interested in obtaining them and am confused on what needs to happen at this point. Do I need to get the house transferred to my name and then when she dies I can obtain my portion by selling the house? Does the house need to go in both of our names? Should I just leave the house in my dad's name and deal with it later when she passes?

So confused, Thanks for any help.
