Extremely Unusual Situation…please Help!

I need to know any and all legal ramifications that could come about from taking my kid out of their home. Location: Texas

I’m going to try to give as much context as I can as simply and shortly as I can. When I was younger I was in an abusive relationship. We had a kid, things got worse. A family I knew offered to take me and kid in and they got us far away and safe. Shortly after leaving I found out I was expecting again. I had a mental breakdown knowing that I couldn’t take care of this kid, I couldn’t even take care of the one I already had. The new family offered to adopt new baby in an open adoption and I accepted. The baby was born, and in the hospital I was put on the birth certificate as the mother and I put the adoptive father’s name as the father. The legal adoption from adoptive mother never happened.

Things were great for a long time! But eventually I came to realize that that family was actually toxic and manipulative and I was too lost in the fact that they were my saviors to see it that way. About a year and a half ago I stopped talking to the family, but have been able to talk to kid occasionally but he had to hide it from them.

I got to talk to him again today. He wants to leave, he wants to move in with me! He is unhappy and aware of the toxicity and manipulation and wants no part of it. He has been “homeschooled“, but parents stopped paying for it so he can’t graduate. He’s 17 and has never had a real friend because he never gets to leave the house. I want to help him, and I will do everything I possibly can to help him because I’m the reason he was there in the first place. (In my poor defense, I didn’t know… I feel horrible)

I’m still on the birth certificate, but so is adoptive father and they are the ones he’s lived with for 17 years. Can I get him? What do I need to do, legally? Do we need to wait until he’s 18?
