Difficult Family Situation

Currently, my ex-wife(31) is going through legal proceedings for multiple felony counts. The prosecution has video evidence and multiple eyewitnesses, I find it unlikely she won’t be convicted. She is facing up to 80+ years in prison and $800,000 fine (max punishments). We have one daughter together(10), and she currently has primary residency. My question is, is now the time to file to petition for primary residency to go to me? Or will courts want the outcome of the case prior to looking at it and reviewing it? Another complication might be that the current court order is in a state where neither her nor our daughter lives, but where I currently live. Would I also need to change the court venue, just for it to come right back to the state I currently live in? I’m not sure what the right answer is.
