Contractor Surprised Me With 40% Extra Cost At End Of Job

Card image cap

I have a contractor that did work at my home and we never had a signed contract. He just gave us a verbal price for the work that was agreed to be done. At the end of the job he wrote down the original verbally agreed amount on an invoice and then added 40% as extra line items which were never agreed on. He claims it was extra material costs, which is absurd. He's not budging, and since we never agreed, or even have an original or amended written contract my only course of action is to refuse to pay the bogus invoice (I already paid the original verbally agreed amount). I understand he can put a lein on my house, or take me to small claims court (the surprise invoice line item is close to the small claims court limit but under it). What should I do here, from a legal perspective, and if he does place a lein or sue me for the surprise invoice line items, what is my recourse and chance of success? Any advice is greatly appreciated. Location: North Carolina
