Capital One Credit Card Threatening To Sue For 23 Years Debt.

Hi, my mother just received a phone call from a law firm saying that they are representing Capital One and that they are going to sue my mother for a unpaid credit card debt from 2001. The balance is just over $1000. The issue is, my mother never had a credit card with them in 2001 as her and my father could never get approved due to back credit and my father's identity being stolen by his brother. The lawyer had her date of birth and her social security. He also said they had served her a month prior but this was the first we had ever heard of this. The lawyer went on to say that she was given papers on April 23 at our home but this would be impossible because we had sold the home on April 21 and had moved across the state (Florida) and were living in a different city on April 23. So it is impossible for her to be served. Also my mother does now have a credit card with Capital One that she got back in 2018 and it has a zero balance on it. So we don't know how she could get on from them in 2018 if she owned them from 2001.

Do they have a right to sue after 23 years? Or is this a scam, giving that my mother just sold her home? What information should we ask for to prove if this is real? Thanks in advance.
