Can My Father Sue For Visitation Rights For My Toddler Daughter? Ny

My dad, who is the biological grandfather of my toddler daughter, is threatening to sue for visitation rights.
I will try to keep this brief. This is the first time he has been cut off from visiting my daughter. The main reason he was cut off from my daughter was because he was combatant to our wishes as parents to keep our daughter safe.
He spends most his time with my older brother, and he was well aware my brother was both using and withdrawing from cocaine while he’s been on probation. He knew my brother used cocaine and 2 days later he took my daughter to the park with my brother!
I felt incredibly uncomfortable with my daughter being around an active cocaine addict, and this boundary had already been established prior that we as the parents did not feel comfortable with this. My dad hid it from us, and I only found out because my brother finally told me.
I have some texts showing that my dad actively knew this entire time that he was bringing my daughter around someone with an ongoing illegal drug problem.
Is it likely my dad would be awarded visitation time if I bring my concerns to a family court? He also threatened to call CPS once he had found out that he was being cut off.
He called CPS 10 times while him and my mother were together, and he was warned not to call CPS anymore or he would be charged criminally.
