~$40,000 In Wages Unpaid

I recently discovered that the Fortune 500 company I worked for in NYS had not been paying me prevailing wage rate on jobs for 5 years. The DOL had an investigation into this and had determined that I had been underpaid approximately $8/hr and is forcing the company to pay me for the last two years. Apparently the DOL can only go back two years, which seems ridiculous.
The company contacted me regarding this and let me know they will be mailing me a check. I asked about the other three years that were also underpaid and the response I received was “we’re not required to reimburse you for those years.”
Do I have any recourse for seeking the remainder of my underpayment from this company? I’ve considered legal action and currently have legal insurance through my new employer. I imagine my previous employer will put up a costly fight since it’s taken about 14 months to get reimbursed from the DOL investigation.
The remainder of money owed is ball park 50k.
